Terms of service

1. Responsible entity

During Xovi Phase 0, from May 16, 2026 to August 10, 2026, the service is operated by Habacuc Isaías Vera Hernández, an individual conducting business activities, as the operational and tax manager of payments associated with Xovi.

If in the future the individual or entity operating Xovi or managing payments associated with the service changes, we will update these terms on this same page. When the change is relevant to users, we will inform them through the available contact channels or through a visible notice on the site.

2. Nature of the service

Xovi, operated under the AxoloDAO brand, is a participatory conservation platform connected to the care, observation, and dissemination of axolotls housed at BioMuseo Xolotlcalli. During Phase 0, the service includes symbolic subscriptions, one-time contributions, access to live streaming, participation through clips, and other digital features related to the project, according to the selected plan and the technical availability of the platform.

Subscriptions, contributions, and payments made through Xovi contribute to the operational sustainability of the project, including the daily care of the axolotls, their feeding, the maintenance of suitable water and habitat conditions, welfare monitoring, digital infrastructure, live streaming, and operational coordination.

These contributions do not constitute a tax-deductible donation or the legal adoption of a specific specimen.

3. Subscriptions

  • Subscriptions may be monthly or annual, depending on the plan selected by the user.
  • Monthly subscriptions renew automatically at the end of each period, unless previously cancelled through the Stripe payment portal or through the channels enabled by Xovi.
  • Prices are shown in Mexican pesos (MXN) and include applicable taxes when applicable.
  • You may cancel your subscription at any time. Cancellation prevents future charges, but it does not always imply an automatic refund of charges already processed.

4. Payments and one-time contributions

Xovi may receive payments or one-time contributions through Stripe, using the payment methods available on the platform, or through on-chain operations in ETH, USDC, or other digital assets to addresses associated with AxoloDAO, including treasury.axolodao.eth.

Contributions and one-time payments made through Stripe are processed using the methods available on the platform. When a refund is applicable, it will be issued to the original method used in Stripe, in accordance with the Refund policy.

On-chain operations are irreversible once confirmed on the corresponding network. Before confirming an operation, the user must carefully verify the network, token, amount, and destination address. Xovi cannot cancel, modify, reverse, or refund a transaction confirmed on a blockchain network.

Operations sent to the wrong network, to the wrong address, or from a wallet not controlled by the user are not recoverable through Xovi.

Tax receipts or CFDI may be issued when applicable, provided that the user supplies the necessary tax information correctly and in a timely manner.

5. Access to the service and availability

Xovi offers access to live streaming, digital content, participation features, clip submissions, validations, and other tools related to the project, according to the selected plan and the technical availability of the platform.

Xovi will make reasonable efforts to keep the service available and functional. However, service availability may depend on technical, operational, or third-party provider factors. Therefore, Xovi does not guarantee uninterrupted availability, error-free operation, permanent continuity of the live stream, or specific results derived from conservation activities.

6. Intellectual property

The trademarks, names, logos, design, interface, texts, graphics, audiovisual material, software, documentation, and other elements related to Xovi, AxoloDAO, and BioMuseo Xolotlcalli belong to their respective owners.

Use of the service does not transfer any intellectual property rights over those elements to users. It is not permitted to copy, modify, distribute, reproduce, commercially exploit, register, sublicense, or otherwise misuse the elements of the service without the prior and express authorization of the corresponding rights holder.

7. Conduct and suspension

By using Xovi, you agree not to send spam, illegal, malicious, misleading, discriminatory, threatening, or harassing content, content that infringes third-party rights, or content that affects the operation, security, integrity, or availability of the service.

You also agree not to improperly manipulate participation systems, validations, clips, accounts, wallets, payments, metrics, rewards, or any technical function of the service.

Xovi may suspend, limit, or terminate access to accounts that breach these terms, engage in fraudulent activities, misuse the service, or create legal, technical, operational, or security risks for Xovi, AxoloDAO, BioMuseo Xolotlcalli, other users, or third parties.

Suspension, limitation, or termination of access does not automatically create a right to a refund. Refunds, when applicable, will be reviewed in accordance with the Refund policy and applicable law.

8. Limitation of liability

Xovi is offered as a digital platform for participation, dissemination, and operational support for the project. Xovi will make reasonable efforts to keep the service available and functional; however, to the extent permitted by applicable law, it will not be responsible for technical interruptions, failures of third-party providers, connection errors, maintenance, loss of access due to causes beyond Xovi's control, blockchain network errors, operations confirmed by the user on an incorrect network or address, or for specific results derived from conservation activities.

Nothing in these terms limits non-waivable rights that consumers may have under applicable law, nor does it exclude liability where such liability cannot be legally excluded.

9. Links, providers, and external services

The service may depend on external providers such as Stripe, hosting services, databases, streaming platforms, wallets, blockchain networks, or other technology services. Use of those services may be subject to their own terms, policies, and conditions.

10. Applicable law and disputes

These terms are governed by the laws of the United Mexican States. Any dispute related to the use of Xovi will be handled in accordance with applicable law and before the competent authorities or courts.

The foregoing does not limit any rights that users or consumers may have under applicable law, including any applicable attention, conciliation, or complaint mechanisms.

11. Changes to these terms

Xovi may update these terms to reflect operational, legal, technical, or commercial changes to the service. Any modification will be published on this same page, indicating the date of the last update. When the change is relevant to users, they will be informed through the available contact channels.

If you do not agree with the updated terms, you may stop using the service or cancel your subscription through the available mechanisms. Continued use of the service after the changes take effect implies acceptance of the updated terms, unless applicable law requires a different form of consent.
